NOTICE OF DISPOSITION OF LAND FOR LESS THAN MARKET VALUE

April 17, 2024

PURSUANT to Sections 70 and 606 of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M-26, as amended, the Council of the Town of Pincher Creek in the Province of Alberta hereby gives notice of its intention to dispose of the following municipal property for less than its market value:

            Lot 14, Plan 552LK – (656 Charlotte Street)
            Lot 13, Plan 552LK – (655 Main Street)
            Lot 103, Plan 460B and Lot 102, Plan 552LK – (659 Main Street)
 
THE PURPOSE of the proposed disposition is to allow the opportunity for medium density housing and potential mixed-use commercial development as a secondary use in a form acceptable to Council, with multi-unit housing development being the main priority.
 
The development allowed is based on plans that are compliant with the Direct Control land use district in consideration of the constraints of the site, compatibility with adjacent public, institutional, and commercial land uses, and that align with Council’s vision and goals for the development of the site and the downtown area in general.
 
AND WHEREAS the Council of the Town of Pincher Creek at their regular meeting on April 8, 2024, accepted the offer from Link Builders for purchase of the combined properties of 656 Charlotte Street (Lot 14, Plan 552LK), 655 Main Street (Lot 13, Plan 552LK) and 659 Main Street (Lot 103, Plan 460B and Lot 102, Plan 552LK) for $50,000 including GST and direct administration to prepare a real estate purchase agreement based on conditions identified within the Request for Proposals.  (Resolution 24-169)
 
AND WHEREAS the current assessed value of the property is as follows:
            Lot 14, Plan 552LK – (656 Charlotte Street) - $49,690
            Lot 13, Plan 552LK – (655 Main Street) - $49,030
            Lot 103, Plan 460B and Lot 102, Plan 552LK – (659 Main Street) - $185,280
            For a total current assessed value of $284,000
 
AND WHEREAS a sufficient petition must be received by the Chief Administrative Officer within 15 days of the last publication of this notice and shall contain on each page “an accurate and identical statement of the purpose of the petition.”  Only electors of a municipality are eligible to be petitioners.  Further requirements of the petition are provided in Section 224 of the Municipal Government Act.
 
THEREFORE, TAKE NOTICE THAT Council of the Town of Pincher Creek, unless a petition of the electors for a vote on Resolution 24-169 is demanded, as provided for by the terms of Section 231 of the Municipal Government Act, the said Council may proceed with the disposition of land.

PRESS RELEASE – STAGE 1 WATER RESTRICTION IN EFFECT

April 24, 2024 - For immediate release – On Monday, April 22, 2024, Town Council passed the amended Water Utility Bylaw. Changes to the bylaw include the trigger points for enacting water restrictions in the Town of Pincher Creek. This update was requested by the province as part of the Town of Pincher Creek’s Drought Management Plan.
 
The Town of Pincher Creek has moved from Stage 2 Water Restriction to Stage 1 Voluntary Water Conservation effective April 24, 2024 based on the Water Utility Bylaw 1631-24 revisions of April 22, 2024.

Council for the Town of Pincher Creek has accepted an offer from Link Builders for the purchase of 656 Charlotte Street, 655 Main Street, and 659 Maint Street for a total of $50,000.
